Terms of Use
Effective 5 October 2026 · Last updated 5 October 2026
The short version
- This is a website about a product we have not finished building.
- Joining the waitlist is free, and it does not promise you anything.
- Essember is not a medical service and not an emergency service.
- Please do not misuse the site or send us other people's information.
1What these terms cover
These terms are an agreement between you and Stillwell Care, Inc. (“Stillwell Care,” “we,” “us”) about your use of this website. By using the site or joining the waitlist, you agree to them. If you do not agree, please do not use the site.
They do not cover the Essember application or service, which does not exist yet. When it launches it will have its own terms, and you will have to agree to those separately.
We measure how this website is used so that we can improve it. What that involves, and what it does not, is set out in our Privacy Notice.
2Essember is not available yet
Everything described on this website is what we intend to build. Features may change, be delayed, be replaced, or never ship at all. Nothing on this site is a promise that any particular feature will exist, work a particular way, or be available at a particular time or price.
Where the site shows an example screen or an illustration, it is an illustration. It does not show a real person's information.
3The waitlist
Joining the waitlist is free and creates no contract to supply you with anything. It does not reserve a place, guarantee you access, guarantee a price, or guarantee that Essember will launch at all. We may close the waitlist at any time.
The features you tick are a signal, not an order — we only build something if enough people say they want it. You can leave the waitlist at any time by emailing admin@stillwell.care.
How we handle what you give us is set out in our Privacy Notice.
4Not medical advice, and not for emergencies
Nothing on this website is medical advice. Essember, when it exists, is intended to help a family share information that the person being cared for has chosen to share. It will not diagnose anything, will not make clinical decisions, and will not replace a doctor, a nurse, a pharmacist or a caregiver.
Never rely on this website or on Essember in an emergency. If someone is in danger or needs urgent help, call 911 or your local emergency number.
5How you may use the site
Use the site for your own lawful purposes. You agree not to:
- Attempt to gain unauthorised access to the site or anything connected to it
- Scrape, harvest or bulk-download the site, or submit entries automatically
- Interfere with the site or place an unreasonable load on it
- Submit another person's name or contact details without their permission
- Use the write-in box to send abusive, unlawful, or deliberately false content
- Send us health information, financial account details, or government identification numbers
We may remove any submission and decline to contact anyone, for any reason.
6What you send us
If you type a suggestion into the write-in box, you are giving us permission to read it, count it, and use the idea to decide what to build. We do not have to credit you, keep it confidential, or pay you for it, and you should not send us anything you consider a trade secret or want to keep private. You confirm that what you send is yours to send.
7Our content and name
The Essember and Stillwell Care names, the text, the design, the images and the code on this site belong to Stillwell Care, Inc. or to the people we licensed them from. You are welcome to link to this site and to share the link. Please do not copy the site wholesale, present it as your own, or use our name or branding in a way that suggests we endorse you.
8Links to other sites
Any link to another company's website is there for convenience. We do not control those sites, we are not responsible for them, and a link is not an endorsement.
9No warranty
The site is provided “as is” and “as available.” We do not promise that it will always be available, uninterrupted, error-free, or that the information on it is complete or current. To the fullest extent permitted by law, we disclaim all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10Limit on our liability
To the fullest extent permitted by law, Stillwell Care, Inc. and its officers, directors and employees will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, revenue or goodwill, arising out of or relating to your use of this website — whether the claim is based in contract, in tort, or on any other legal theory, and even if we have been told such damages are possible.
To the fullest extent permitted by law, our total liability arising out of or relating to this website will not exceed one hundred US dollars ($100).
Some states do not allow the exclusion or limitation of certain damages. If you live in one of them, some or all of the limits above may not apply to you, and nothing in these terms limits any liability that cannot lawfully be limited.
11Governing law
These terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or this website will be brought in the state or federal courts located in Guilford County, North Carolina, and you and we each consent to the jurisdiction of those courts. Nothing here prevents either of us from bringing a claim in small claims court.
12Changes to these terms
We may update these terms. The date at the top shows when they last changed. If you continue to use the site after a change, you accept the updated terms.
13The rest
If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce something straight away, we have not given up the right to enforce it later. These terms, together with the Privacy Notice, are the whole agreement between you and us about this website.
